International Comparative Legal Guide to Public Procurement 2017: Kazakhstan

The new public procurement law entered into force on 1 January 2016.

The new public procurement legislation brings significant improvements to the current legislation by promoting increased quality procurement projects, controlling the growth of the budget expenses, reducing bureaucracy and supporting innovation in the development of public projects. It remains to be seen how the authorities will actually apply such new regulation and how the debates that have been already initiated in relation to certain provisions will be resolved by the courts of law.

Cancellation of apostilization requirement between Russia and Kazakhstan in respect of tax residence certificates

Please be informed that Kazakhstan and Russia agreed on cancellation of apostilization requirement in respect of documents confirming tax residence.

On 14 of November 2016 the President of the Republic of Kazakhstan signed the Law “On ratification of the agreement in form of notes exchange on recognition procedure of official documents confirming residence issued by the competent authorities of the Republic of Kazakhstan and the Russian Federation in the framework of the Convention between the Government of the Republic of Kazakhstan and the Government of the Russian Federation on avoidance of double taxation and prevention of tax evasion in respect of income and capital.

Starting from 1 September 2015 there is the requirement established by the Federal Law dated 21 July 2014 No. 242-FZ with respect to operators of personal data to provide for recording, classification, collection, storage, clarification (updating, changing), and retrieval of the personal data of citizens of the Russian Federation by using databases located in the territory of Russia. Exemptions from this obligation are provided by the Federal Law dated 27 July 2006 No. 152-FZ "On Personal Data". 

According to the decision of Tagansky Court of Moscow upon the claim of Roskomnadzor against LinkedIn Corporation (USA), the administrator of websites  
http://www.linkedin.comhttp://linkedin.com, this social network has been processing the personal data of Russian citizens in a breach of the abovementioned requirement.

Shaimerden Chikanayev will participate as moderator in the Almaty Invest Forum: “Investing in Almaty - Global Perspectives”
V International Investment Forum Almaty Invest 2016 will be held on December 8-9, 2016 in Almaty, Kazakhstan. The event is organized by Almaty City Administration and will focus on investment opportunities in Almaty. 

The annual Almaty Invest Forum will bring together over 500 high-level participants, including state representatives, world and domestic business leaders, executives of financial institutions, investment corporations and international organizations

On 3-4 November 2016, the XI Kazakh Forum of Corporate Lawyers was held in Almaty.

Shaimerden Chikanayev gave a presentation at the National Chamber of Entrepreneurs of the Republic Kazakhstan "Atameken" public hearings in Almaty on the topic: "Examples of successful PPP projects realisation in the Republic of Kazakhstan "
Among the participants of the hearings were representatives of Ministry of National Economy of RK, Ministry of Healthcare and Social Development of RK,  JSC "Kazakhstani center of Public-Private Partnership" and other.

On November 25, in the AmCham Boardroom, Rixos Hotel Business Center, 8th Floor, the Healthcare Reform WG Meeting was held.

Nurbol Kissembayev took part in Aktau AmCham Sundowner
On November 10, 2016 in Aktau AmCham Sundowner was held. The sundowner was organised by the American Chamber of Commerce in Kazakhstan. Attendees of the event included general directors and managers of large companies.

GRATA International together with the Arbitration Institute of the Stockholm Chamber of Commerce and Mannheimer Swartling hosted seminars: "Arbitration in Stockholm related to Kazakhstan – commemorating 25 years of efficient and peaceful dispute resolution"
The seminars, which were held on November 29th in Astana and November 30th in Almaty, included presentations on innovative features of the SCC’s proposed new arbitration rules, interactive case studies involving mock SCC arbitration clause negotiations and mock SCC arbitral proceedings, as well as discussions regarding new developments in Kazakh arbitration law. Russia-China Law Society or RCLS is a non-profit organisation created on the basis of the Law Faculty at Lomonosov Moscow State University, which is mainly aimed at the promotion of professional contacts between representatives of the legal society in the Russian Federation and Chinese People’s Republic.

The main objectives of the RCLS include, in particular, creation of a communication platform for lawyers of both countries, popularisation of Chinese law in Russia, ensuring interaction between public associations in Russia and China, assistance in entering the Russian and Chinese markets, respectively.
