Citizens for Fair Representation

Press Release

For Immediate Release
December 5, 2018

Citizens Decry Institutional Tyranny

“Institutional tyranny was declared lawful last week,” stated Mark Baird, spokesperson for Citizens for Fair Representation (CFR), referring to Judge Kimberly Mueller's order dismissing Citizens for Fair Representation v Secretary of State Alex Padilla for lack of standing. The plaintiffs filed suit against Padilla in May of 2017, for lack of representation and dilution of vote.

Baird went on to say, “Mueller's orders say that since all Californians are equally disadvantaged with representative ratios of one million people per State Senator and 500,000 people per each Assembly member, that there is nothing the court will do.” Baird added, “California has the worst representative ratio in the nation. Not only is California's ratio worse than any state in the nation, but far worse than most world governments.”

In 1879, the California State Legislature was capped at 40 in the Senate and 80 in the Assembly, with a population of approximately 440,000. Now, almost 150 years later with population numbers almost 40 million, the number of representatives remains the same. Baird estimates that California citizens vote has been diluted 400%.

CFR believes that Judge Mueller is commanded by Shapiro v McManus (U.S. Supreme Court) and U.S. Code Title 24, Section 2284 and must request a three judge court be appointed in any dilution of vote

case, with the reasoning that a single judge can never be trusted with the sanctity of the people's vote.
According to CFR early on in the case Judge Mueller did in fact uphold the law ordering a three judge court only to make an unprecedented decision one week later to reverse her own ruling, admitting what CFR believes to be illicit conversations with another court.

Baird said, “While Judge Mueller's actions were not unexpected, they are disappointing. CFR believes this action to be unconstitutional.” Baird further stated, “It leaves us wondering whether all it takes for oligarchy and dictatorship to flourish is a judge who will support tyranny as long as all are equally harmed by it!”

After consulting with their attorneys of record, Scott Stafne and Gary Zerman, along with their legal consultants, Alex Kozinski, former Chief Judge of the U.S. Court of Appeals for the 9th Circuit and Professor Steward Jay, University of Washington State School of Law, Citizens for Fair Representation decided they will enter into the appeals process.

CFR is dedicated to the proposition of representation in districts small enough that legislators will be forced to consider those who elect them, no matter their political affiliation. “And to that end, CFR will continue to fight for equal/fair representation and liberty for all California's citizens.” said Baird.

Terry Gherardi

WE MUST FIGHT!

Ladies and Gentleman of Jefferson,

As some of you may have already heard, Judge Muller has dismissed our complaint again. Although this is disappointing, it is not unexpected. This Judge has already made the unprecedented action of calling for a three judge court as commanded by the law, only to “change her mind” one week later. Further misconduct in her dismissal should not be a surprise to any of us.

I have spoken individually with each of our attorneys. WE MUST FIGHT!

No one but the citizens of Jefferson are actively doing anything to stop the institutional dictatorship in California. This court has gone on record as saying that tyranny and dictatorship are ok as long as everybody is equally harmed by lack of representation.

If we fail to fight, no one will do this for us. If we fail to gain Liberty through adequate representation, no one will just up and give it to us. There is no where to run and no where to hide from the storm that is approaching our freedom. WE MUST FIGHT!

We will appeal! Yes this Democrat Judge has made it more difficult. No one ever said this would be easy or a sure thing. We must exhaust all legal, moral and ethical avenues to regain our Liberty through adequate representation in districts small enough to ensure accountability to the people! We will file an appeal in appellate court. The judge made some rather serious procedural errors in her ruling and in her conduct. With the addition of Trump appointments to the Ninth Circuit, our odds increase.

Have faith that our true judge, the beneficent creator of the world, will smile upon the rectitude of our intentions, as we publicly pledge our lives, our fortunes, and our sacred honor to secure the blessings of Liberty to ourselves and to our posterity. Please remember that Liberty has a price. It has always had a price. If our generation fails to pay, the next will pay their share and ours until

finally the burden cannot be shouldered by ordinary means.

If you have doubts, consider the following. Ballot harvesting is a felony in most states. Ballot harvesting was the method used by The Democrat party to win House seats in California’s conservative districts, and they consider it a great idea. Gavin Newsom has publicly stated his disdain for Second Amendment Liberty, and in fact has publicly stated his disdain for everything most of you stand for.

The Mono Party has a super majority in both houses of government as well as a socialist in the Governors mansion. Twenty-three counties went Democrat in the Governors race and 31 counties voted conservative and yet no Conservative has held a state wide office in over a decade. Fewer than half of registered voters bother to vote. Why?

Because it is widely perceived that your vote counts for nothing! Worse, it is true! Our votes have been diluted 400% since our state’s founding. We suffer under the worst representative ratio in the nation, 350 percent worse than state number 49, at one million people per senator and one half million per assemblyman. Most national governments have better representation than we do in a single state. One quarter of the people tell three quarters how things are going to be and they say if you don’t like it, get out! Free speech is now called hate speech, just as George Orwell predicted in his book “1984”. Plastic straws and cow farts are banned while illegal alien criminals murder our fellow citizens and suck our treasury dry. All with the official blessing of the rats, liars and crooks in Sacramento.....We must fight!!!

Ladies and Gentlemen of the twenty three counties of Jefferson, we are it! No one is rushing to save us from the apathy to Liberty in this state. If we want this we will have to fight for it! The appeal has already begun. Pray for strength. Have faith. Prepare for the fight that will surely follow.

Liberty or Death,

Mark Baird
