The ability to restrict visitation in guardianships has always been a point of friction.  At what point does freedom of association bend to safety issues? When has a guardian gone too far? What are unreasonable visitation demands? How can visitation be tailored? What does the new law say on the issue? Is visitation with the spouse different from visitation with others? This panel presentation will discuss these conundrums from the perspectives of the court, guardians, and attorneys representing guardians and people subject to guardianship, factoring in the delicate balance between preferences and safety.
