Essential steps for defending employee discipline & discharge
Somewhere along the line, you’ve had to discipline an employee; you may have even had to let one go. While it’s not easy to do, from a legal standpoint, you need to have just cause, and you need to do it by the law. If you don’t, your dealership could face some hefty fines.
If you’ve decided it’s time, you need to know how to build a proper case that supports terminating an employee. Whether disciplining or discharging an employee, you must know what ‘just cause’ is, how to understand it and when to use it.
And if you’re unclear on what to do, how to do it, when to flip the switch, please join us for a special Employers Council seminar, 7 Essential steps for defending employee discipline and discharge, 7 a.m. Wednesday, September 19 at CADA Headquarters.
Designed for managers, supervisors and HR specialists, this informative and interactive seminar, which uses real-life scenarios that lets you work with and examine the basic principle (‘just cause’) underlying proper disciplinary procedures.
|
|
|
You'll learn:
- How to understand and implement the seven steps of just cause
- Methods for establishing effective notice of rules among employees
- What constitutes a legitimate work rule
- How to contextualize an employee’s entire work record when determining discipline
- How to identify and avoid disparate treatment
- How to identify a supervisor’s role in establishing just cause
- How to determine the appropriate penalty to be administered
- To plan and conduct an effective investigation
- How to document discipline
|
|
|
If you want to stay on the right side of the law — AND understand how ‘just cause’ can help win unemployment claims or dismiss discrimination charges, register for this important seminar.

4 simple rules to prevent cyber phishing attacks at your dealership
Have you or anyone on your sales team ever received an e-mail from another dealer who wants to look at a vehicle you have on the lot? Chances are that you have. It’s something that happens thousands of times a day across the country. There’s a whole business built on accessing sensitive information in your database through such a seemingly innocuous — and common — activity.
It’s called cyber phishing and auto dealerships across the country have been identified as ‘easy’ targets for these aggressive cyber phishers. And once they have access to your database, cyber phishers hold it for ransom, usually for tens of thousands of dollars, yet some dealerships have paid much more than that. If you’ve been cyber phished, it will bring your business to its knees.
There are actions you can take right now to prevent that from happening to your dealership. Please join CADA on Wednesday, October 10, from 10 – 11:30 a.m. for the special webinar, 4 Simple rules to prevent cyber phishing attacks at your dealership. This webinar is designed for dealers, general managers, sales managers, controllers and CFOs. (And because it’s a webinar, you might want your sales team to sit in on it, too.) Thank you for your donations!
When you donate a car, truck, SUV or van to the Clear the Air Foundation, you change a life. Your generosity sometimes makes the difference between someone staying the course to get their auto technician degree — or dropping out to keep the low-paying job they already may have. Many thanks to the following dealers who donated cars last week. That makes 24 vehicles donated to date in September — and translates to $4,800 in scholarships.

New tool scholarship for auto tech students
Thanks to partnerships with Snap-on Tools and Matco Tools, the Clear the Air Foundation is developing a tool scholarship, which will provide qualifying students with a credit that can be applied toward tools. Both offer student discount programs that essentially double the award, as the programs offer discounts of up to 50 percent.
The tool scholarship is being developed as an alternative to a tuition scholarship. Some students are able to cover their tuition costs with grants, scholarships or by working while going to school. Yet ALL students all need tools, and you well know that by the time they become Master ASE Automotive Technicians their tool costs can easily exceed $25,000.
Currently, requirements for tool scholarships mirror those of the tuition scholarship and decisions are made on a case-by-case basis. We’re also working with service managers and instructors to help scholarship winners select the best tools required for their job.
Eric Woodbury: First Foundation Tool scholarship winner
I am thrilled to announce that Eric Woodbury received a $2,500 tool scholarship last week. He works full time at Markley Honda, while attending Front Range Community College.
Terry Brunk, service manager at Markley Honda, explained that when Eric started there one year ago, they knew he was someone special. Eric quickly moved from the car wash to a Honda Service Express Tech position and has excelled ever since. “Clear the Air Foundation's money will be well spent with Eric,” he said.
Along with Snap-on Tool's Student Excellence program, the $2,500 tool scholarship will be parlayed into $5,000 worth of tools — which will go a long way in helping Eric prepare for a rewarding career as an Automotive Technician.
For questions about the donation process, please contact Mark Zeigler, or call 303-775-8896.

Regulatory & legal updates

Auto Industry Division is MOVING
The Auto Industry Division, the chief regulator of the automotive industry, is leaving its long-time headquarters at 1881 Pierce St. in Lakewood. Its last day in the office is September 28, 2018.
The Division will be closed Friday, September 28 and Monday, October 1 to facilitate the move.
The Division re-opens Tuesday, October 2 at 143 Union Boulevard, Lakewood, CO 80228, on the third floor.
Incidentally, these are temporary headquarters. The Division will move again in late 2018 into its permanent headquarters in Golden.
Updated Form 2698 – VIN Verification
Several weeks ago, we announced here that the DMV created an amended form DR 2698 for VIN Verifications. The new form should reflect a date of 06/15/18. The grace period for dealers to use inventory has now expired (09/15/18).
Click here for the updated version of form DR 269. If you have any questions, please contact Matthew Groves.
Emergency tax regulations
In response to the U.S. Supreme Court’s decision in the Wayfair v. South Dakota case, the state of Colorado has issued a tax regulation under its emergency authority to modify Colorado’s sales and use tax collection in adherence to this decision.
This rule will justify the Department of Revenue’s (DOR) recent change of policy to enforce sales tax collection licenses for each taxing jurisdiction (requiring leasing companies to apply for dozens of licenses using a form DR 440). It also will allow taxing jurisdictions to tax a transaction when the jurisdiction has no nexus to the transaction. In other words, it obliterates the concept of a remote sale for on-line retailers. This potentially creates tax collection issues on leasing transactions for dealers.
Collecting sales or use tax on a lease is now cited to two different locations. The first payment will be taxed as though the transaction occurred at the dealership. All subsequent payments will be taxed as though the transaction occurred at the site where the vehicle is to be registered.
CADA has requested a meeting with the DOR to ascertain how it intends to enforce this “multiple situs” taxing method, in the absence of technology that can track two sites for one transaction. Meanwhile, DOR is requesting an additional 12.6 full-time employees and $1.25 million from the legislature to enact the new regulations.
