Clear the Air Foundation makes great progress

Thanks to dealers who have donated vehicles the first half of July!

A big thank you to all of you dealers who are committed to a clean environment by donating vehicles to the Clear the Air Foundation. As you know, your donations help make scholarships possible for auto tech students throughout Colorado.

From July 1 – July 13, the Clear the Air Foundation received 23 vehicle donations, bringing out year to date total to 321. With a strong finish, we can post our best year yet!

Here is a recap of the first two weeks of July:
  • 8 vehicles from John Petro at Stevinson Toyota West
  • 3 vehicles from Larry Mondragon at Dale Spradley Motors
  • 2 vehicles from Joanna Black at Perkins Motors
  • 2 vehicles from Chris Goode at Glenwood Springs Subaru
  • 2 vehicles from Jen Todd at Emich Volkswagen
  • 1 vehicle from Jason Horton at Hellman Motor
  • 1 vehicle from Patrick Schnall at John Elway Chevrolet
  • 1 vehicle from Jared Thaut at Kuni Lexus of Greenwood Village
  • 1 vehicle from Brian Sears at Stevinson Toyota East
  • 1 vehicle from Aaron Ziek at Turner Automotive
  • 1 vehicle from Chris Wiethoff at Bighorn Toyota

One more item worth mentioning is that a few select vehicles donated to the Foundation are being loaned to Pikes Peak Community College, as the vehicles those students work on were destroyed in a recent hail storm. They are in desperate need of late model/hybrid or clutch vehicles before classes begin at the end of August.

The Clear The Air Foundation has already loaned the program three vehicles with more on the way, but we need your help! Once students are finished wrenching on them, they will be recycled. The Foundation will receive the same amount of money for the donated vehicle, but with the added benefit of helping students prepare to work in your dealership. Please let Mark Zeigler know if you will donate a vehicle that fits their needs.

If you have a vehicle or two to donate, contact Mark Zeigler mark.zeigler@colorado.auto, Clear the Air Foundation manager. And remember, if you don’t get those junkers as trade-ins, Clear the Air accepts cash donations.
Regulatory & legal updates
Motorcycles only: August brings
new temp tags — and temp tag holders

As part of the transition to the new DRIVES program at all 64 Divisions of Motor Vehicle across the state, and in Lakewood, a new temporary registration permit (“temp tag”) will be issued for all motorcycles sold. This tag will be smaller in size, designed to fit the back of a motorcycle. Previously, motorcycles were using the same temp tags as motor vehicles.

**Motor Vehicle dealers should note that this change will not apply to them. Motor Vehicle temp tags are the same as they were before.**

The new temp tag holders, much like the existing holders for motor vehicles, are also cardboard backed and manufactured by the Colorado Correctional Industries (“CCI”). CADA is one of a very few licensed retailers for CCI products. We are placing our order for the new temp tag holders this week and will have them available as soon as they are permitted for distribution, on August 6, 2018. At that time, they will be available through our forms ordering website, at https://www.colorado.auto/order.

If you have any questions about the new temp tag holders, please contact Matthew Groves, at matthew.groves@colorado.auto, or 303.282.1449.

FTC 'Compliance sweep" seeks buyers' guide violations

If you receive NADA’s 60 Seconds e-mails, you have probably seen the results of the Federal Trade Commission’s (FTC) recent effort to inspect compliance with the 2017 Used Car Rule. Recall, this rule requires (among other things) a Buyer’s Guide posting in each used car for sale on a dealer’s lot. While a new Buyer’s Guide was approved in early 2017, it was not mandated until January 1, 2018, giving dealers a phase-out period to use their inventory of the old Buyer’s Guides.

Now that the phase-out period is over and the new Buyer’s Guides are required, the FTC has sent agents out across several states in what they refer to as a “first” sweep. They are also using “partner agencies” to increases their reach, so a Buyer’s Guide audit may come from a more familiar agency. While Colorado was not among the first set of states to be audited, we can assume that this will be coming our way soon.

Of those dealerships visited across seven states, only 14 dealerships had the new version of the Buyer’s Guides on ALL required vehicles.

Buyer’s Guides may be purchased through the CADA Forms website at www.colorado.auto/order. If the bottom line of the form reads: “Si el concesionario gestiona la venta en español, pídale una copia de la Guía del Comprador en español”, Then you are looking at the current version of the form.

If you have any questions, please contact Matthew Groves, at matthew.groves@colorado.auto.
